Panda Pay Electronic Communications Consent
This Electronic Communications Consent explains how Panda Pay will provide disclosures, notices, and other information to you electronically, and describes your rights and choices regarding those communications.
By creating a Panda Pay account, using the Panda Pay app or website, or clicking a button labeled "I Agree," "Continue," or similar, you consent to receive required disclosures and other communications from Panda Pay electronically, as described in this Electronic Communications Consent ("Consent"). If you do not agree, you should not use the Services.
1. Title & Introduction
This Consent explains how electronic delivery works for communications related to your use of Panda Pay services. It applies to your use of the Panda Pay mobile application, our website at pandapay.money, and any related tools, features, or accounts (collectively, the "Services").
By accepting this Consent, you agree that we may provide certain communications electronically rather than in paper form, and that your electronic consent has the same legal effect as a handwritten signature or paper agreement.
This Consent forms part of our Terms & Conditions and should be read together with those Terms and our Privacy Policy.
2. Definitions
For purposes of this Consent:
- "Panda Pay," "we," "us," or "our" means Panda Pay and our affiliates, agents, and service providers acting on our behalf.
- "You" or "your" means the individual who accesses or uses the Services and who provides this Consent.
- "Communications" means any legally required or important information related to the Services, including disclosures, agreements, notices, statements, receipts, confirmations, alerts, policies, account information, transaction details (including cash advance information), and updates to these documents.
- "Services" means the Panda Pay app, website (including pandapay.money), and any related tools, content, features, or financial products we provide.
3. Scope of Electronic Communications
Your Consent covers all Communications related to the Services, including but not limited to:
This includes any disclosures required in connection with financial features offered through the Services.
- Panda Pay Terms & Conditions and any updates or amendments to those terms.
- Our Privacy Policy and any updates or amendments to that policy.
- Regulatory disclosures, account opening information, and any statements or notices required by law to be provided in writing.
- Account notices, summaries, or statements, including information about cash advances, payments, repayment dates, and transaction history.
- Security alerts, fraud notifications, and important messages about the safety of your account.
- Customer support messages and responses to your inquiries.
- Any other information or documents we choose to provide in connection with the Services.
4. Methods of Electronic Delivery
We may deliver Communications to you electronically in any of the following ways, to the extent permitted by law:
- By email, sent to the email address associated with your Panda Pay account.
- By SMS or text message, sent to the mobile phone number associated with your account.
- By in-app messages or other messages displayed within the Panda Pay app.
- By posting information or documents within your account, on our website, or in another digital location we designate.
We do not send marketing text messages.
We may choose any of these methods for a given Communication. In some cases, we may send an email or notification telling you how to view the Communication electronically (for example, by logging in to the app or website).
Depending on your mobile plan and carrier, message and data rates may apply to SMS or text messages.
5. Technical Requirements
To receive, view, and keep electronic Communications, you must have access to the following minimum technology:
- A valid, active email address and a mobile phone number.
- A device (such as a smartphone, tablet, or computer) with internet access.
- A current web browser capable of securely accessing web pages and displaying HTML content (for example, recent versions of Safari, Chrome, or similar).
- For some documents, the ability to view PDF files or similar formats and a way to save or print Communications for your records.
It is your responsibility to ensure that your hardware, software, and internet connection meet these requirements and remain capable of receiving electronic Communications.
We recommend that you download or print a copy of this Consent and any important Communications for your records.
6. Updating Your Contact Information
You must keep your contact information current so we can reach you. This includes your email address, mobile phone number, and mailing address (if provided).
You can update your contact details in the Panda Pay app (for example, in account or settings pages) or by contacting us at support@pandapay.money. If you do not update your information, we will continue to send Communications to the last contact details you provided, and those Communications will be deemed received.
7. Paper Copies & Withdrawing Consent
You may request a paper copy of certain Communications when required by law. We may charge a reasonable fee for paper copies, unless prohibited by law, and we will tell you about any fee before providing the copy.
You may withdraw your Consent to receive Communications electronically at any time by contacting us at support@pandapay.money or, where available, by changing your communication preferences in the app.
If you withdraw your Consent, we may be unable to continue providing some or all of the Services. Any withdrawal of Consent will not affect the legal validity of Communications previously provided electronically.
8. Legal Acknowledgments
By providing this Consent, you agree that electronic Communications we send to you have the same legal effect as paper communications. They satisfy any requirement that a communication be in writing or delivered in a particular form.
We may update this Consent or the ways we deliver Communications from time to time, as permitted by law. When we make material changes, we will notify you by email, within the app, or by another reasonable method, and we will update the "Last updated" date at the bottom of this page.
9. How You Provide Consent
By taking any of the following actions, you confirm that you can access this Consent electronically and agree to receive Communications electronically as described above:
- Clicking "I Agree," "Continue," or a similar button or checkbox in the app.
- Creating a Panda Pay account or completing sign-up steps after viewing this Consent.
- Continuing to use the Services after being presented with this Consent or an updated version of it.
If you do not agree to this Consent, you should not use the Services and should contact us to discuss available options, which may be limited.
10. Effective Date & Updates
This Consent becomes effective when you first accept it or when you first use the Services after being presented with it, whichever occurs first.
We may update this Consent from time to time. When we make material changes, we will notify you and update the "Last updated" date. Your continued use of the Services after changes take effect means you accept the updated Consent.
